Fair Usage Policy – PlansXpress & Quick Plan

1. Purpose of This Policy

This Fair Usage Policy (“Policy”) defines the permitted levels of usage for PlansXpress and Quick Plan, including automated plan‑creation features. Its purpose is to ensure all customers receive a consistent, reliable service and to prevent excessive or abusive usage that may negatively impact system performance or breach licensing restrictions. 

This Policy forms part of the Terms and Conditions governing the use of PlansXpress and Quick Plan. By installing, registering, or using the software, you agree to comply with this Policy. 

2. Scope

This Policy applies to: 

• All users of PlansXpress 

• All users of Quick Plan 

• All subscription tiers and perpetual licences 

• All versions, updates, patches, and enhancements 

3. Fair Usage Principles

HBXL licenses PlansXpress and Quick Plan for use by small to medium‑sized building companies, sole traders, and home‑design professionals as an ancillary tool supporting construction‑related work. 

To maintain system integrity and ensure equitable access, usage must remain within the thresholds associated with the licence tier purchased. 

Fair usage is determined by: 

• The number of automated plans generated 

• The frequency of plan creation 

• The intended use (ancillary to construction work, not mass‑production) 

• The licence tier purchased (Extensions‑only, Extensions + New Builds, etc.) 

4. Automated Plan‑Creation Limits (Quick Plan)

Quick Plan includes automated drawing and parametric plan‑generation features. These features are subject to usage thresholds determined by the licence tier purchased. 

4.1 Licence‑Based Thresholds

Your licence tier determines: 

• The number of automated plans you may generate per year 

• Whether new‑build plans are included 

These thresholds are communicated at the point of sale, in Subscription Terms & Conditions, or in written communication from HBXL. 

4.2 Tiered Usage Model for New Builds

Quick Plan is designed for genuine builders and construction professionals who produce a realistic number of projects each year. You may produce an unlimited number of home extensions using Quick Plan, subject to Section 4.3. 

To keep pricing fair and sustainable, new‑build usage is licensed according to the number of units your business builds per annum. This ensures each customer selects the tier that reflects their actual workload. 

• Tier 1 – Up to 10 units per annum Suitable for small builders completing occasional new builds. 

• Tier 2 – Up to 20 units per annum Ideal for growing firms with a steady flow of projects throughout the year. 

• Tier 3 – Up to 50 units per annum Designed for established SMEs producing regular new builds. 

• Tier 4 – Up to 100 units per annum For high‑volume construction businesses with multiple projects running concurrently. 

• More than 100 units per annum Please contact HBXL to discuss a commercial‑scale licence. 

Why We Use Tiers 

The tiered model ensures: 

• Fair access – preventing excessive or industrial‑scale usage 

• Right‑sized licensing – you only pay for the usage level your business genuinely needs 

• Scalability – upgrade your tier at any time as your business grows 

• Protection against misuse – Quick Plan is not licensed for mass‑production of drawings or architectural‑practice‑level output without a commercial licence 

4.3 Prohibited Usage

You must not: 

• Use Quick Plan to mass‑produce drawings or templates 

• Operate a commercial plan‑production service using Quick Plan 

• Generate plans in volumes inconsistent with SME construction workflows 

• Circumvent usage limits or attempt to automate bulk plan creation 

• Use Quick Plan for architectural or design‑practice‑level output without a separate licence 

5. Monitoring and Enforcement

HBXL may monitor usage patterns to ensure compliance with this Policy. Monitoring may include: 

• Number of plans generated 

• Frequency of plan creation 

• Repeated generation of similar plans 

• Automated or scripted usage 

• Usage inconsistent with SME construction activity 

Monitoring is conducted solely to enforce licensing conditions and maintain service quality. 

6. Exceeding Fair Usage Thresholds

If HBXL reasonably determines that your usage exceeds the thresholds applicable to your licence, HBXL may: 

• Require an upgrade to a higher licence tier 

• Apply additional charges for excessive usage 

• Restrict or suspend access to Quick Plan 

• Terminate your licence in accordance with the Terms and Conditions 

HBXL will normally notify you before taking action unless excessive usage poses a risk to system integrity or breaches contractual terms. 

7. Business‑Use Restrictions

Quick Plan is licensed only as an ancillary tool within your construction‑related business. 

You may not: 

• Provide plan‑creation services to the mass market 

• Sell or distribute plans created using Quick Plan without HBXL’s written consent 

• Use Quick Plan as the basis for a standalone design or architectural service 

• Create plans for third parties beyond your construction clients 

A separate commercial licence is required for any extended or non‑ancillary use. 

8. Updates to This Policy

HBXL may update this Policy from time to time. Any changes will be communicated via: 

• HBXL’s website 

• Installer or registration screens 

• Subscription renewal notices 

• Direct email communication 

Continued use of PlansXpress or Quick Plan constitutes acceptance of any updated Policy.
